The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared financial and corporate details of his racing venture, saying he put in $40m of his own funds into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”
The Core Dispute: Charter Agreements and Renewal Demands
The heart of the case involves the end of a 2016 agreement where Nascar granted each team a “charter”. The concept is similar to other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar demanded teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to a media frenzy, with fans and media clamoring for a view or a photo of the global icon.
Spearheading the Fight
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is unlawful to keep two hands on the wheel.
For Jordan and and a fellow team representative, who testified before Jordan, are events from last September. She recounted a frantic and emotional period where the sanctioning body informed teams they must sign a charter agreement extension. The document consists of over a hundred pages detailing team compensation and a guaranteed spot in every race.
Choosing Litigation
Jordan explained that his team and its ally decided their only feasible option was to refuse a signature that extensive document and litigate the matter. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.
The Ultimate Motivation: Victory
But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.
“Denny convinced me adding a third car boosted our odds of winning,” he testified, noting that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I dove in.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.
She said, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader refused the appeal.
“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
